Supreme Court Halts Trump’s Attempt to Deploy National Guard to Chicago

Breaking News: The Supreme Court has rejected former President Trump’s request to authorise the deployment of the National Guard to Chicago following unrest in 2020.

The Supreme Court on Monday declined to hear a case brought by Donald Trump seeking to overturn rulings that blocked his attempt to federalise the Illinois National Guard and deploy it to Chicago during summer 2020 protests. The decision effectively ends the former President’s legal challenge. The initial request arose from demonstrations following the death of George Floyd.

Trump’s administration argued the deployment was necessary to quell violence and protect federal property. However, the Seventh Circuit Court of Appeals ruled Trump lacked the authority to deploy the Guard without the consent of Illinois’s Governor, J. B. Pritzker. The administration then appealed to the Supreme Court, which refused to grant review.

According to Fox News, the case centred on the Posse Comitatus Act, which generally prohibits the use of the US military for domestic law enforcement purposes. The Daily Mail reported that Trump’s legal team contended an exception to the act applied, given the unrest and potential threat to federal buildings. The Jerusalem Post noted this dispute occurred during a period of heightened tensions regarding law and order across multiple American cities.

The American Civil Liberties Union (ACLU) hailed the Supreme Court’s decision, stating it affirmed the “critical constitutional principle of civilian control of the military”. The ACLU argued, as reported by The Sun, that Trump’s attempt represented a dangerous overreach of executive power. The case highlighted clashes between federal authority and states’ rights, particularly around managing civil unrest.

The legal battle is now closed, precluding any further attempts by Trump to deploy the National Guard to Chicago based on this specific request. The ruling reinforces the established limitations on presidential authority regarding the deployment of military forces within US states.
